根据内幕信息对内幕交易的影响，可以将内幕信息分为利好型内幕信息和利空型内幕信息。以股票买卖为例，内幕信息知情人员进行内幕交易，其必然是在掌握利好信息时买入股票以谋取股票上涨的利益，也必然是在掌握利空信息时卖出股票以避免股票下跌的损失。实践中，获取利好型内幕信息的人员一般是在内幕信息公告后停止涨停时卖出相关股票，除非其从内幕信息知情人员处获取了预期价位。因此，在未获取股票预期价格信息的前提下，对利好型内幕信息公开后继续持股未卖，且公开当日股票价格未出现涨停的，如何认定获利数额存在不同看法。一种观点认为，应当以公开当日的账面所得认定获利数额；另一种观点认为，应当以案发当日的账面所得认定获利数额。笔者赞同前一种观点。随着证券期货市场的发展，内幕交易与操纵证券、期货市场行为往往交织进行。一些庄家对股票价位的操纵，并非是一步到位，可能分阶段操作。因此，只要行为人从内幕信息知情人员那里获取了股票的预期价位，不管股票在复牌当日有无涨停，其后续持股获利的数额亦应当计入获利数额。如果行为人未获取股票的预期价位，内幕信息公开后其继续持有的，除连续涨停情形外，与内幕信息关联不大，故把握的一般原则是不计入获利数额。对于此种情形，一般将内幕信息公开当日的账面获利认定为违法所得。如在王文芳泄露内幕信息、徐双全内幕交易案件中，徐双全2012年2月3日从王文芳处获悉“德赛电池(000049,股吧)”股票即将因资产重组而停牌的内幕信息，于2月20日德赛电池公司发布《关于重大资产重组停牌公告》并正式停牌前连续买入“德赛电池”股票62万余股，3月26日德赛电池公司发布《关于终止筹划重大资产重组事项暨公司证券复牌公告》并于同日复牌。显然，徐双全从王文芳处获悉的德赛电池公司资产重组信息属于利好型内幕信息，但在复牌日宣告重组失败，“德赛电池”股票未出现涨停。在此情况下，徐双全在复牌后没有马上抛售“德赛电池”股票，而是选择继续持股。之后该股票价格呈上涨趋势，徐双全于3个月后陆续抛售所有涉案股票，共获利730万余元。现有证据无法证实徐双全获取该股票预期价位信息，根据“德赛电池”股票价格变化情况，徐双全继续持股的行为宜归因于其对市场的判断而作出的选择，但复牌日的获利因与利用内幕交易存在因果关系，故徐双全的违法所得应当将复牌之日2012年3月26日的账面获利认定为获利数额，而不能将实际获利的730万余元全部认定为获利数额。
