笔者认为《相互保险办法》中互助基金不是履行“保险人”对价保险义务的适格主体，基金不应作为责任赔偿主体，基金本身更不是保险人。基金属于会员自治、共治的资金平台，互助成员通过“订立契约”成为会员。基金所形成的资金平台应由全体互助成员管理或委托第三方管理。
